SB 778 Extends Deadline for California Sexual Harassment Training

To start 2020, a number of laws passed in the California legislature went into effect, including SB 778 in the workplace training and safety sphere. This extends the compliance deadline for SB 1343, which was passed in 2018, from January 1, 2020, to the first day of 2021.

SB 1343 requires that all companies with at least five employees provide supervisory staff with two hours of sexual harassment training. In addition, nonsupervisory staff must receive an hour of such training within their first six months at the company, as well as following a promotion to a supervisory position. All staff must receive sexual harassment training again every two years following the initial session.

The new law also provides clarification that those employers who provided training in 2019 are not required to provide such training again until 2021. It does not change any aspect of the timeline for temporary and seasonal workers, however, who must receive sexual harassment training before they pass 100 hours or 30 days of employment.
